These conditions of sale are concluded on the one hand by the company LCDO B, registered in the trade and companies register of ANNECY under the number 792487753 hereinafter referred to as “BIUTIFUL” and on the other hand, by any person wishing to proceed. to a purchase via the website www.biutifulshop.com, hereinafter referred to as "the customer". These conditions are addressed to a consumer who has full legal capacity. These conditions apply to all orders that the customer will place on this site. These conditions apply to all sales made from this site, to the exclusion of all other conditions, in particular those in force for in-store sales. We do everything possible to satisfy you. On this site, we present all the essential characteristics of the products to you. We will be attentive to the comments you send us via the "contact" section.
SUBJECT:
The purpose of these conditions of sale is to define the contractual relationship between BIUTIFUL and the customer, and the conditions applicable to any purchase made through the merchant site of www.biutifulshop.com.
The acquisition of a product through this site implies unreserved acceptance by the customer of these conditions of sale.
BIUTIFUL reserves the right to modify its conditions of sale at any time. In this case, the applicable conditions will be those in force on the date of the order by the customer.
CHARACTERISTICS OF THE PRODUCTS OFFERED:
The products offered are those which appear in the catalog published on the BIUTIFUL website. These products are offered within the limits of available stocks.
Minimal differences between a product and its photograph may exist, depending in particular on the resolution and the definition of the colors of the user's screen.
Some images and descriptions are taken from information provided by BIUTIFUL suppliers.
We try to show the color of our products as faithfully as possible, but you should take into account that the quality, configuration and resolution of the computer screen or the device it is viewed on may affect color perception, which may cause a slight color difference between the actual product and that reflected on the screen.
RATES:
The prices appearing in the catalog are prices including all taxes in euros taking into account the VAT applicable in France on the day of the order; any rate change may be reflected in the price of the products.
BIUTIFUL reserves the right to modify its prices at any time, it being understood however that the price appearing in the catalog on the day of the order will be the only one applicable to the customer.
The prices indicated in the catalog do not include the costs of processing and delivering orders.
The delivery price is automatically added and indicated during the order finalization phase.
ORDERS :
The customer who wishes to buy a product must:
- Complete the identification form on which he will fill in the required fields;
- Validate his order after having checked it;
- Make the payment under the conditions provided;
The confirmation of the order implies acceptance of these conditions of sale, the recognition of having full knowledge of them and the waiver of its own conditions of purchase or other conditions.
All the data provided and the recorded confirmation will constitute proof of the transaction.
Confirmation will be worth signing and acceptance of transactions.
BIUTIFUL will communicate by e-mail the confirmation of the recorded order.
Failure to pay for all or part of the order would automatically and without formality result in the temporary cancellation thereof. In this case, BIUTIFUL will contact the customer in order to restore the situation.
According to law n ° 80.335, the goods sent to the customer remain the entire property of BIUTIFUL until full collection of the sums due.
BIUTIFUL reserves the right not to validate the order in the event of abnormal or abusive complaints, abnormal orders with regard to the quantities ordered, abnormal or abusive exchanges and returns, existing dispute (s) with the customer.
WITHDRAWAL:
The customer has a withdrawal period of fourteen days from the delivery of his order to return the product unpacked and in perfect condition (no return will be made on an item whose packaging has been damaged).
The Products must be returned in their original packaging, with their label and any accessories, in perfect condition to:
BIUTIFUL - 4bis rue de la Poste - 74000 ANNECY - France.
The return to BIUTIFUL for exchange or refund will then be made without penalty, with the exception of the return costs which will remain the responsibility of the customer (under article L. 121-20). The totality of the sums paid will be refunded to the customer at the latest within thirty days following his withdrawal. On BIUTIFUL's proposal, the customer may also opt for another reimbursement method. In the event of an incomplete or damaged return, the refund will not be accepted.
SALES:
Items sold on sale will not be returned, exchanged or refunded (apart from the right of withdrawal which remains applicable).
PAYMENT TERMS :
Payment of the full price is due when ordering. Payments made by credit card will be made through the secure STRIPE system so that the information transmitted is encrypted by software and that no third party can become aware of it during transport on the network.
Payments can also be made by Paypal. With PayPal, the customer's financial information is never communicated to BIUTIFUL. Indeed, PayPal encrypts and protects the buyer's card number.
STOCKS AND REASSORTS:
All items marked “in stock” are available and can be shipped the same day for orders placed before 14pm. In the exceptional case where the ordered goods are not in stock, BIUTIFUL will contact you to proceed either to the restocking of the ordered product, or to the cancellation of the order.
DELIVERIES:
Deliveries are made to the address indicated in the order form. The risks are the responsibility of the purchaser from the moment the products have left the premises of BIUTIFUL. In the event of damage during transport, a reasoned protest must be made to the carrier within three days of delivery.
Upon delivery, you must check whether the package is damaged in front of the carrier and refuse it if so.
Any report made after opening a damaged package cannot be taken into account.
The customer can contact BIUTIFUL by telephone for any question relating to its delivery (see the "contact" section). In the case of delivery outside French territory, the order may be subject to possible taxes and customs duties when it arrives at its destination.
The payment of these duties and these taxes is the responsibility of the customer and BIUTIFUL invites the customer to inquire with the competent authorities of his country.
Delivery delay :
• Chronopost 24h. Same day dispatch - Tuesday to Friday - for all orders placed before 14pm. The delivery times indicated are the delivery times indicated by the services of Chronopost. These contractual deadlines may be extended for any cause that has made it impossible for BIUTIFUL to fulfill its obligations, in particular in the event of force majeure within the meaning of article 1148 of the Civil Code (strike, accident, war, natural disaster, case of events over which BIUTIFUL cannot reasonably have control).
• DHL Express 24 hours. Same day dispatch - Tuesday to Friday - for all orders placed before 14pm. The delivery times indicated are the delivery times indicated by DHL. These contractual deadlines may be extended for any cause that has made it impossible for BIUTIFUL to fulfill its obligations, in particular in the event of force majeure within the meaning of article 1148 of the Civil Code (strike, accident, war, natural disaster, case of events over which BIUTIFUL cannot reasonably have control).
• Colissimo 48h. Same day dispatch - Tuesday to Friday - for all orders placed before 14pm. The delivery times indicated are the delivery times indicated by COLISSIMO. These contractual deadlines may be extended for any cause that has made it impossible for BIUTIFUL to fulfill its obligations, in particular in the event of force majeure within the meaning of article 1148 of the Civil Code (strike, accident, war, natural disaster, case of events over which BIUTIFUL cannot reasonably have control).
A delay in delivery can in no way justify the cancellation of the order.
GUARANTEE:
All the products offered by BIUTIFUL benefit from the legal guarantee provided for by articles 1641 and following of the Civil Code. In the event of non-conformity of a product sold, it may be returned to BIUTIFUL who will take it back, exchange it or reimburse it. All complaints, requests for exchange or refund must be made by post to the following address: BIUTIFUL - 4BIS RUE DE LA POSTE - 74000 ANNECY - FRANCE within a period not exceeding thirty days from the date of delivery.
The customer must keep the purchase invoice to be able to benefit from his contractual guarantee. In the event of a refund, BIUTIFUL will reimburse all of the products made non-compliant, as well as the shipping costs incurred, with the exception of taxes and customs duties paid by the customer upon delivery.
RESPONSIBILITY :
BIUTIFUL, in the online sales process, is only bound by an obligation of means; it cannot be held liable for damage resulting from the use of the Internet network such as loss of data, intrusion, virus, interruption of service, or other unintentional problems.
INTELLECTUAL PROPERTY :
All the elements of the BIUTIFUL site are and remain the intellectual and exclusive property of BIUTIFUL.
No one is authorized to reproduce, exploit, redistribute, or use for any purpose whatsoever, even partially, elements of the site whether they are software, visual or sound.

ARCHIVING:
BIUTIFUL will archive purchase orders and invoices on a durable and reliable medium constituting a faithful copy in accordance with the provisions of article 1348 of the Civil Code.
DISPUTE SETTLEMENT :
These online sales conditions are subject to French law.
In the event of a dispute, the customer first turned to BIUTIFUL to obtain an amicable solution and in the absence of an agreement, jurisdiction is attributed to the competent courts of Annecy, notwithstanding plurality of defendants or call in warranty.
